Article 1 – Definitions

In these terms and conditions, the following definitions apply:

- Reflection period: The period within which the customer can exercise their right of withdrawal.

- Customer: Defined as either a private customer, a natural person not acting in a professional or business capacity, or a business customer, either a natural or legal person acting in a professional or business capacity, entering into a distance contract with FD Ricambi.

- Day: Calendar day.

- Durable data carrier: Any method that allows the customer or FD Ricambi to store information directed personally to them in a way that future consultation and unaltered reproduction of the information are possible.

- Right of withdrawal: The customer's option to cancel the distance contract within the cooling-off period.

- Distance contract: An agreement where the system organized by FD Ricambi for the distance selling of products or services uses one or more techniques for distance communication up to and including the conclusion of the agreement.

Article 3 – Applicability

1. These general terms and conditions apply to every offer from FD Ricambi and every distance contract and orders concluded between FD Ricambi and the customer.
2. The text of these general terms and conditions is provided to the customer before concluding the distance contract. If this is not reasonably possible, it will be indicated that the terms and conditions can be viewed at FD Ricambi, and they will be sent free of charge upon the customer's request.
3. If the distance contract is concluded electronically, the terms and conditions will be made available electronically in advance so that they can be stored easily on a durable data carrier.

Article 4 – The Offer

1. Offers are non-binding and subject to explicit conditions if any, which will be stated in the offer.
2. Offers contain a complete and accurate description of the offered products and/or services to enable a proper assessment by the customer.

Article 5 – The Agreement

1. The agreement is concluded upon acceptance of the offer by the customer and meeting the conditions associated with it.
2. FD Ricambi confirms receipt of the electronic acceptance of the offer immediately upon receipt.

Article 6 – Right of Withdrawal

1. Customers can dissolve the agreement without stating reasons for a reflection period of 30 days following the receipt of the product.
2. Customers must handle the product and its packaging with care during this period and return the product according to the provided instructions if they decide to withdraw. See the FD Ricambi Product Return Terms for all applicable return conditions.
3. Customers bear the costs of returning the product.

Article 8 – Pricing and Incoterms

1. Prices within the validity period of the offer will not increase. All prices are presented in Euros and under the Incoterm EX WORKS.

Article 9 – Conformity and Warranty

1. FD Ricambi guarantees that products and services meet the agreed specifications, reasonable reliability and usability standards, and legal regulations as of the agreement date.
2. The warranty period provided is 1 year for new and refurbished products and 1 month for used products. See the FD Ricambi Product Warranty Terms for all applicable warranty conditions.

Article 10 – Delivery and Execution

1. FD Ricambi takes great care in receiving and executing product orders and services.
2. The specified delivery address is where delivery will occur.

Article 11 – Payment, Ownership, and Shipping

1. Payment is due at the time of order unless a service agreement specifies otherwise. Ownership transfers upon full payment.
2. FD Ricambi arranges shipment, with the risk of damage or loss transferring to the customer unless insured by them.

Article 12 – Complaints Procedure and Liability

1. Complaints must be reported to FD Ricambi within 7 days of discovery.
2. FD Ricambi will address complaints within 14 days of receipt.

Article 13 – Disputes

1. Disputes will be governed by Dutch law and settled exclusively in Amsterdam courts, irrespective of customer location.

Article 14 – Privacy Policy

Customers consent to the processing of their personal data in line with FD Ricambi’s privacy policy.
